Given the context for doing business now, the growing uncertainties, the complexity, the sheer amount of goals to hit, a new way of contracting with suppliers may be needed?

The growth of outcome based contracting (OBC) seems assured, but what is the best way of accomplishing OBC …?

Developing more ‘flexible’ contracts seems essential when there is uncertainty about the how the solution is going to be delivered, how it might evolve over time, what improvements will come in, how risks might pan out? But how is such a process best actually designed and managed? 

Moreover, this approach fits with AGILE procurement – yet should we be ‘AGILE contracting or ‘contracting for AGILE’ outcomes? And what is the difference anyway? 

And, then, why is it impossible to include penalties, maybe even compensations or liquidated damages, in any form of AGILE contracts?
